TERMS OF SERVICE

1. Definitions
“UCBA”, “we”, “us”, and “our” mean the Ukrainian Canadian Bar Association.
“Website” means the UCBA website and any related online services.
“Services” means the Website, membership services, events, communications, and resources made available by UCBA.
“User” means any person accessing or using the Services.
“Content” means any text, images, materials, data, or other information made available through the Services.

2. Acceptance of Terms
By accessing or using the Services, the User agrees to be bound by these Terms of Service. If the User does not agree, the User must not use the Services.

3. Eligibility and Use of Services
The Services are intended for members of the legal profession and other individuals approved by UCBA.
The User shall use the Services only for lawful purposes related to professional development, networking, and resource sharing.
The User shall conduct themselves in a professional manner and shall not engage in conduct that is unlawful, abusive, or that interferes with the operation of the Services.

4. User Accounts
Where registration is required, the User shall provide accurate and current information and shall update such information as necessary.
The User is responsible for maintaining the confidentiality of account credentials and for all activity under their account.

5. Membership
Membership may be subject to eligibility criteria, fees, and separate membership terms.
Fees, if applicable, are payable in accordance with UCBA policies.
UCBA may suspend or terminate membership in accordance with applicable policies.

6. Content and Intellectual Property
All Content provided by UCBA is owned by or licensed to UCBA and is protected by applicable intellectual property laws.
The User is granted a limited, non-exclusive, non-transferable licence to use the Content for personal and professional purposes in connection with the Services.
The User shall not reproduce, distribute, or commercially exploit Content without prior written authorization.
User-contributed content remains the property of the contributor. The contributor grants UCBA a non-exclusive, worldwide, royalty-free licence to use, reproduce, modify, and display such content in connection with the Services.

7. Prohibited Automated Access
The User shall not use any automated means, including bots, crawlers, or scraping tools, to access, collect, or extract data from the Website without prior written authorization from UCBA.
UCBA may grant exceptions at its discretion upon written request.

8. Third-Party Services
The Services may include links to or integrations with third-party websites or services. UCBA does not control and is not responsible for such third-party services.

9. No Legal Advice
Content provided through the Services is for informational and professional development purposes only and does not constitute legal advice.

10. Suspension and Termination
UCBA may suspend or terminate access to the Services where the User breaches these Terms or where necessary to protect the integrity of the Services.

11. Disclaimer
The Services are provided on an “as is” and “as available” basis. UCBA makes no representations or warranties regarding the accuracy, completeness, or availability of the Services.

12. Limitation of Liability
To the extent permitted by law, UCBA shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of the Services.
UCBA’s total liability shall not exceed the amount paid by the User, if any, for the Services in the preceding twelve months.

13. Indemnity
The User agrees to indemnify UCBA from claims arising from the User’s use of the Services or breach of these Terms.

14. Amendments
UCBA may amend these Terms from time to time. Continued use of the Services constitutes acceptance of the amended Terms.

15. Governing Law
These Terms are governed by the laws of the Province of Ontario and the laws of Canada applicable therein.

16. Severability
If any provision is found to be unenforceable, the remaining provisions shall remain in effect.

17. Entire Agreement
These Terms constitute the entire agreement between UCBA and the User regarding the Services.

PRIVACY POLICY

1. Scope and Application
This Privacy Policy describes how the Ukrainian Canadian Bar Association (“UCBA”, “we”, “us”) collects, uses, and discloses personal information in connection with its website and related services (the “Services”). This Policy is intended to comply with applicable Canadian privacy laws, including PIPEDA and Quebec Law 25 where applicable.

2. Responsibility for Personal Information

UCBA may collect the following categories of personal information:

– membership and registration information

UCBA requires service providers to use personal information only for the purposes for which it is disclosed and to implement appropriate safeguards. UCBA does not sell personal information.

Personal information may be processed or stored outside of Canada. Before communicating personal information outside Quebec, UCBA conducts an assessment of the factors relating to the protection of such information, in accordance with applicable law.

8. Retention, Destruction, and Anonymization
Personal information is retained only for as long as necessary to fulfill the identified purposes or as required by law. When no longer required, personal information is securely destroyed or anonymized.
